In one case, the Russian Constitutional Court protected the rights of bona fide creditors of a Russian legal entity that, although not bankrupt, was deleted as inactive from the Unified State Register of Legal Entities. Also, the court clarified that creditors face objective difficulties in obtaining evidence when filing a claim for subsidiary liability of the debtor’s controlling person outside of bankruptcy proceedings. The decided case was remanded to the originating authority for further review.
